WHAT IS LITIGATION?

Litigation is a process when Legal Action is instituted against you / you institute Action against another person and such action becomes defended either by you or by the person you instituted Legal proceedings against.

Litigation involves many Legal Notices and documents to be drawn up, exchanged and delivered between the Applicant/ Plaintiff’s Attorney, Respondent/ Defendant’s Attorney and the relevant Court.  Depending on the nature of the claim, the matter may be settled out of Court failing which the matter goes to Trial where it is argued in Court by the relevant Lawyers and/or Advocates before a Judge.   Wayne argues and appear his own Litigation matters, as well as matters on behalf of correspondent attorneys in Magistrate Court  but employs the expertees of an Advocate for Supreme / High Court matters.

Arguing and appearing before Magistrate’s Court is one of Wayne’s specialities.  He enjoys, prepare and research his appearing Court matters extensively before going on Trial.

We operate across the entire East Rand Divisions of the Magistrate’s Court  as well as the Magistrate and High Court for Johannesburg and Pretoria.

WHAT IS DEBT RECOVERY?

Debt recovery is when someone owes you money – occupational rent, monies for goods sold and delivered, monies loaned, etc.

An initial consultation which include perusing of all of your documentation  relating to the(single)  action to be instituted as well as a letter of demand to the debtor is R950-00.  Wayne will advise you on how strong your case is, alternatively, the weaknesses of your case.  We believe in honesty and will not take a client ” for a ride “.   To try and avoid expensive and protracted Legal action / costs we usually suggest to our client to commence action via letter of demand whereafter we can advise our client on which way to proceed further depending on the response received from the debtor.  The attorney need to show proof of delivery of the letter of demand to the Court and should action proceed thereafter, all processes i.e Summons, Warrant of Execution, etc, has to be served by the Sheriff of the Court.
